5.                  ESCONDIDO CHARITABLE FOUNDATION GRANT ACCEPTANCE Request Council authorize the Fire Chief to accept a grant award of $12,853 from the Escondido Charitable Foundation After the Fires Fund 2007; authorize the Fire Chief to execute grant documents on behalf of the City; and authorization for the needed budget adjustments to track spending of these grant funds

6.                  REVISION TO THE WATER CONSERVATION ORDINANCE Request Council adopt Ordinance 2009-28 for revisions proposed to amend Ordinance No. 2009-16 to update the current Water Conservation regulations by expanding the number of outdoor watering days permitted November-May during a Response Level 2, and the type of equipment exempted from time limits

7.                  ELEVENTH AVENUE PARK SITE CONSULTING  AGREEMENT AND BUDGET ADJUSTMENT Request Council authorize the Mayor and City Clerk to execute a contract with RJM Design in the amount of $15,000, to provide staff technical assistance in pursuing the grant funding to build the 11th Avenue Park site; and authorize a Budget Adjustment in the amount of $15,000 from the Amphitheater Improvement Capital Account to the project

8.                  SECOND AMENDMENT TO THE CONSTRUCTION MANAGEMENT AGREEMENT WITH MCCUSKY GROUP FOR THE POLICE AND FIRE HEADQUARTERS Request Council authorize the Mayor and City Clerk to execute a Second Amendment to the Construction Management Agreement with the McCuskey Group, Incorporated, in the amount of $299,378, in order to extend the contract through February 2010

            RESOLUTION NO. 2009-157

9.                  GRANT AN EASEMENT ACROSS CITY PROPERTY TO SAN DIEGO GAS & ELECTRIC (SDG&E) FOR THE INSTALLATION OF EQUIPMENT TO PROVIDE SERVICE TO A PRIVATE RESIDENCE Request Council authorize the Real Property Manager to execute an Easement to SDG&E across City Parcel APN 241-150-16 to place and maintain transmission equipment to service a private residence

10.              LEASE FOR THE ESCONDIDO CITIZENS ECOLOGY COMMITTEE Request Council authorize the Real Property Manager and City Clerk to execute a Lease Agreement with the Escondido Citizens Ecology Committee for the property located adjacent to Centre City Parkway

14.              CALIFORNIA CENTER FOR THE ARTS FOUNDATION (CCAEF) Request Council (1) Approve the Management Agreements for the Performing Arts, Conference Center and Museum and Education at the CCAEF; (2) Approve the 2009-2010 budget as submitted by the CCAEF;  3) Write off an existing loan of $540,731; and (4) Create and make appointments of a permanent Council subcommittee for CCAE
